Can I record my landlord?

The honest short answer

The consent question is the same as any other conversation and depends on where you both are. What is specific to housing disputes is the rest of it: a recording is only one form of documentation, it is rarely the strongest one, and whether it can be used in a proceeding is for the tribunal or court to decide.

Check Recording Rules

Where you and your landlord are located decides which rule applies. If they are in a different state or country from you — common with agents and management companies — more than one rule may be relevant. Run the checker with both locations.

If you are in a place where every participant's agreement appears likely to be required, saying "I'm recording this so I have an accurate note" at the start of the call is the practical answer.

What actually helps a housing dispute

Recordings are dramatic; paper trails win. In most tenancy disputes the useful documentation is:

  • Dated photographs of the condition, with something in frame for scale.
  • Written requests, sent by a method that shows delivery, and repeated if ignored.
  • A contemporaneous log — date, time, what happened, who was present, what was said.
  • Copies of everything: the tenancy agreement, inventories, inspection reports, invoices.
  • Recordings, where they add something the paper trail cannot.

A recording is most useful when the dispute is about what someone said and there is no other record of it. It is least useful when the dispute is about condition, timing or money, where documents beat audio every time.

Do not record inside their home, and do not leave a device running

Two situations that turn a documentation exercise into a serious legal problem:

  • Recording conversations you are not part of. Leaving a device running to capture the landlord talking to someone else is exactly what interception statutes are aimed at.
  • Recording other people's private space. A landlord's office, another tenant's flat, and shared areas where other residents are talking are all somewhere the rules are stricter and the situation less defensible.

Entry and inspections

If your concern is unannounced entry, notice requirements and quiet-enjoyment obligations are what you should be documenting — dates, times, notice given or not given, and what happened. That is a records problem more than an audio problem.

Whether a recording can be used

Whether a tribunal or court will accept a recording is decided under its own rules, taking into account how the recording was obtained. This tool cannot tell you a recording will be accepted, and a covertly obtained recording can be criticised even where it is admitted. If the dispute matters, take advice before you rely on audio as your main evidence.
